Marine Acquitted In Subway Death - As Law Prof Predicted

Professor Banzhaf's Similar Analysis Helped Subway Shooter Avoid Punishment
 
WASHINGTON - Dec. 9, 2024 - PRLog -- A jury has just acquitted former marine Daniel Penny of all criminal charges in connection with the subway death of Jordan Neely, just as a New York jury refused to convict "Subway Shooter" Bernard Goetz of somewhat similar charges some 40 years ago, notes public interest law professor John Banzhaf.

Banzhaf's legal analysis of the Goetz situation is widely credited with keeping him from being convicted in 1984, and his recent legal analysis, showing why Penny also should be regarded as a good samaritan rather than a criminal vigilante is similar.

As the New York Times noted:  "In New York City, the Penny case drew comparisons to the 1984 subway shooting of four Black teenagers by a white passenger, Bernard Goetz, who said he had been a mugging target. Mr. Goetz instantly became famous — and infamous. Mr. Penny is white and Mr. Neely, a former Michael Jackson impersonator, was Black. Like Mr. Goetz's case 40 years ago, the episode sharply divided New Yorkers and the nation."
