In a recent criminal law matter our client was charged with; stalk or intimidate intending to cause fear of physical or mental harm (domestic violence), intentionally or recklessly destroy/damage property and common assault. All of these charges were domestic violence related charges.

Our client currently lives at home with his parents and work at an airport and earns $800 per week. Our client has no dependence.

The accused and the victim were in an intimate relationship for 9 months, this relationship ended in July 2015. This was at the time where the victim moved out of her grandfather house into her own house. She had allowed the accused the sleepover for a number of occasions. Both parties have no children. There is a witness in this matter, this is a neighbour.

The accused contacted the victim about a barbeque which was his uncle's barbeque, and he wanted it back. The two made arrangements to pick up the barbeque on that day. The victim placed the barbeque at the front of her house on the porch so that the accused could collect it. At about 10pm on that same day, the accused came to the victim's house with a VW hatch and an unknown female with him. The accused got out of the car and walked to the front veranda where the barbeque was placed. As the accused walked to the front veranda the victim walked out and started to abuse the accused, she was screaming and swearing at him about multiple issues, namely how he came to her house with this unknown female who was allegedly texting her about the accused. This yelling and screaming commenced for around five minutes. While the victim was screaming at the accused the accused was cleaning out the barbeque so that he could take it away.

The accused asked the victim about where his barbeque clippers were and if he could have them. The Victim explained that he was unable to have them because he allegedly owed her money. However, the victims continued to get the clippers and placed them on the coffee table. The victim then said she was not going to give the clippers to him and there was nothing that he could do about it, she then started to kick the door. The accused then held the victim by the shoulder and explained why the woman came with him to her house, as he had no other mode of transport. He explained to her to stop thinking the wrong thing. The victim then pushed him off her and swore at him and explained that she did not believe him.

The accused grabbed his clippers and placed them in the car. He then re-entered the victim's house and entered the kitchen to wash his hands. The accused walked past the victim and threw a whit tea towel at her face. The victim told the accused to get out of her house. The accused left her house and walked back to the car, as the victim followed him, she started exchanging words. The victim then grabbed the accused hand and started to squeeze it, she then attempted to grab the keys from the ignition of the car and punched him on his right arm. The accused then moved her out of the way and drove off.

This entire event was witnessed by a neighbour who called the police, which was followed by the victim calling the police. Both the witness and victim have handed in statements and pictures of damaged doors to the police.

Following this our client turned himself into the station.
