By: Imbesi Law P.C. “Brittany defeated one of the largest companies in the United States, that retained one of the largest law firms to represent it against our client,” said Vincent Imbesi, a partner of Imbesi Law P.C. “The FINRA broker-dealer should have corrected its error regarding our client’s wrongful termination and should make changes in its termination procedure because not many people can afford to challenge a large broker-dealer and actually win like Brittany did,” Mr. Imbesi concluded. Pursuant to FINRA's procedural rules, the award was required to be confirmed by a court of competent jurisdiction. Imbesi Law, P.C. petitioned the court on behalf of the broker to confirm the award. On January 13, 2016, the court issued an order confirming the FINRA award and mandating expungement. The court's order set forth: ORDERED, ADJUDGED and DECLARED that petition [of FINRA broker] is granted...and the award of the Financial Industry Regulatory Authority arbitration panel ... is confirmed. All references to the Arbitration be expunged from the registration records of [FINRA broker] maintained by FINRA's Central Registration Depository. Imbesi Law P.C., represents customers, brokers and broker-dealers at FINRA arbitration proceedings, including issues regarding Form U5 expungement. FINRA's expungement process varies depending upon the type of information that is being requested to be removed. FINRA brokers seeking expungement should consult with an attorney to review the various methods available. End
