Partner Daniel Marshall presented at Elder Concert at Florida Atlantic University on October 1st

BOCA RATON, Fla. - Oct. 13, 2015 - PRLog -- On Thursday, October 1^st, Daniel Marshall of Marshall & Berry, P.A. was one of the highlighted presenters at this year’s 15^th annual Elder Concert conference. Elder Concert is a one-day statewide gathering of the growing network of elder care professionals in Florida. This conference is attended by accountants, facility administrators, attorneys, government agencies, financial planners, geriatric care managers, professional guardians, judges, social workers, and other elder care professionals and organizations.

Held at multiple venues around the state of Florida, Mr. Marshall participated at the Boca Raton venue at Florida Atlantic University in the Conference Center of the Student Union. His presentation focused on changes to the Elderly Exploitation statute in the state of Florida that went into effect a year ago. The statute:

1.       Expanded liability for trustees, guardians, and people acting with power of attorney, possibly eliminating the intent element.

2.       Created a presumption of elder exploitation under certain circumstances when a gift is made from an elderly person to someone they recently met.

3.       Gave courts a way to order restitution in a case even before a person is convicted.

In addition Mr. Marshall also focused on:

- The mental health issues that can arise when an elderly person is charged with a crime:

1.       Competency: does the person understand what is going on in court?

2.       Insanity:  was the person sane at the time the offense was committed?
