His presentation focused on changes to the Elderly Exploitation statute in the state of Florida that went into effect a year ago. The statute: 1. Expanded liability for trustees, guardians, and people acting with power of attorney, possibly eliminating the intent element. 2. Created a presumption of elder exploitation under certain circumstances when a gift is made from an elderly person to someone they recently met. 3. Gave courts a way to order restitution in a case even before a person is convicted. In addition Mr. Marshall also focused on: - The mental health issues that can arise when an elderly person is charged with a crime: 1. Competency: does the person understand what is going on in court? 2. Insanity: was the person sane at the time the offense was committed?
