Monitoring of The Florida Bar Continues

BROOKSVILLE, Fla. - March 20, 2015 - PRLog -- This news release can also be used as a Letter To The Editor.

Mlecka started monitoring The Florida Bar when it was found that over 95% of the thousands of complaints filed against lawyers in Florida are dismissed and file closed without any action taken against the lawyer involved.

Since then Mlecka has contacted hundreds of people that have recently found their complaint file closed without any action against their lawyer.

Mlecka found two main reasons given by the Bar for the closure of their complaint. First, "There is insufficient evidence from the materials provided that the (lawyer) has violated any of the rules adopted by the Supreme Court of Florida which govern attorney discipline.  Accordingly, continued disciplinary proceedings in this matter are inappropriate and file will be disposed of one year from date of closing."

And, "If the Bar seeks to discipline a lawyer, it is required by Supreme Court ruling to show by clear and convincing evidence that there has been a violation of one or more of the Rules Regulating The Florida Bar.  Clear and convincing has been defined as evidence so clear, direct and weighty and convincing as to enable the factfinder to come to a clear conviction, without hesitancy, of the truth of the precise facts in issue.  The burden of proof is heavier than the the burden of proof required in an ordinary civil trial and could not be met based on the information provided."

It is found that many complaints to the Florida Bar appear to come from people of lower education, income and from those in jail or prison.  In order to submit a more successful complaint they must follow the necessary procedure required by the Bar.
