Under the current laws and protective agencies in existence during these times it is very difficult to recover damages - but there may be ways.

It is getting more difficult to sue doctors and hospitals for damages because it usually takes another doctor to testify against another doctor That may be difficult to find. Besides, doctors and hospitals have joined group insurance plans to help protect them. Some states have placed limited amounts on amount of money that can be recovered. However, there appear to be plenty of lawyers still willing to take on lawsuits against them, usually hoping for a settlement out of court.
Taking legal action against a lawyer for any reason is much more of a challenge. Like doctors, lawyers generally do not like to sue one another. Most people damaged by a lawyer depend on the state bar association to punish the lawyer. This seldom results in much satisfaction to the person making the complaint. The Bar does not collect money for you as their job is to discipline the lawyer if warranted. To get disbared he must do something very serious.
But things are changing when it comes to taking legal action against a lawyer. About fifteen years ago a lawyer in New York City started doing only lawsuits against other lawyers., Since then the idea has spread throughout the nation. Such lawyers have succeeded in obtaining large settlements in lawyer malpractice cases. Most are settled out of court because the guilty lawyer wants to avoid the publicity that can result when court action is required.
So if someone has a well established and worthwhile malpractice case against a lawyer should feel more confident in knowing there are lawyers that can help you.
