Client Charged with Driving 116 MPH in a 50 MPH Zone has Case Dismissed

Vincent Imbesi obtained a dismissal of a charge against the firm's client that alleged he was driving at a speed of 116 miles per hour, in a 50 miles per hour zone. The charge was dismissed on January 19, 2013.

Jan. 19, 2013 - PRLog -- Attorney Vincent Imbesi obtained a dismissal of a traffic violation that alleged the firm's client was driving his vehicle 66 miles greater than the posted speed limit. The accusatory instrument alleged the client was driving 116 miles per hour on the "Belt Parkway."  The designation was technically incorrect, as the New York highway system does not officially recognize the "Belt Parkway" (the term is commonly used to reference four distinct highways, none of which are officially designated as the "Belt Parkway.")

After making three court appearances on behalf of the client, the charge was finally dismissed on January 18, 2013.  

If convicted of the alleged charge, the client's license could have been suspended.  

New York's VTL Law 1180 (d) establishes monetary fines, as follows:

1180- (d)-1 Speeding in zone  

         >10 mph over limit  $150  $80-$85

         11-30 mph over limit  $300  $80-$85

         < 31 mph over limit  $600  $80-$85
