Wrongful Termination and Discrimination Victim Gets $44,245.00 Settlement through MLG’s Help

According to case records, the client-employee started her employment for an undisclosed home furnishings company as an assistant manager on March 16, 2008. Then, on December 2008, she started to be harassed by a male supervisor. On one occasion, the said supervisor told her to resign from her job post; otherwise, he will find a way to fire her.

Meanwhile, on March 2009, the company’s store manager criticized the client-employee’s dress instead of advising her to refer to the company’s dress code, which resulted in the latter’s humiliation. In another instance, during the months of February and March of the same year, she was again subjected to harassment when another store manager asked her to go back to her former job in a coffee shop and leave the company.

The harassment experienced by the client-employee caused her to suffer from severe anxiety and depression. Consequently, she underwent a medical checkup and was asked by her doctor not to go back to work until May 18, 2009. Her physician promptly forwarded to the company all details regarding her medical condition; however, instead of reasonably accommodating her, in the months of March, April, and May 2009, she was harassed once more by the same store manager who humiliated her because of her dress—this time due to her medical condition.

Records furthered that the company failed to reasonably accommodate the client-employee when she was called by the Human Resources department on May 6, 2009 to go back to work the next day or risk termination. The client-employee explained that she cannot go back to work yet because of her condition and because her doctor advised her not to do so until May 18, 2009. The following day, May 7, 2009, the HR department informed her through a phone call that she has been dismissed from the company.
