Hooper Holmes, et al., (Case Number: 3:12-cv-02398- In this collective action lawsuit, the Paramedical Examiners, Phlebotomists, Insurance Examiners and former employees similarly situated allege that Hooper Holmes and its affiliates violated the Fair Labor Standards Act by failing to properly compensation them for overtime hours. Instead, the lawsuit alleges that even when the workers worked over 40 hours in a work week, Hooper Holmes paid the workers solely their piece-rates, and failed to pay them the additional overtime premiums due them under the law. Morgan and Morgan overtime attorneys Andrew R. Frisch and Angeli Murthy are representing the workers in an effort to recover unpaid wages for the overtime work they performed, but for which they did not receive the proper overtime pay. According to a federal law known as the FLSA, non-exempt employees are entitled to time-and-a-half pay for all hours worked over forty in a given workweek. "This is a situation where an employer has enhanced its earnings by taking advantage of those who can least afford it- the employees. We're fighting to help get them paid their rightful wages," says attorney Andrew Frisch. “We frequently see this type of overtime violation, where an employer pays solely piece-rates and fails to account for overtime hours worked, as required by the law,” added Murthy. All unpaid overtime claims filed by Paramedical Examiners who worked for Hooper Holmes within the last three (3) years and whom were not paid proper overtime are eligible to join the case.
