Man Owes Thousands in Child Support even though Paternity Test Proves he is not the Father

July 9, 2010 - PRLog -- WXYZ Action News in Southfield, Michigan recently reported on a man who owes tens of thousands of dollars in child support for a child he did not father.  The case goes back to 1988 when a boy was born and the child’s mother listed the man as the father of the child with Michigan’s state aid program.

The man in question was actually in jail at the time and when he was released in 2003 he was notified by the state that he could take a paternity test to prove he was not the father.  Having just been released from prison he did not have the funds to pay for a test out of his own pocket.

Years later the alleged father eventually had a paternity test performed that showed he was not the father, but it was too late in the eyes of Michigan law.  The state only allows a limited window for a man to prove he is not the father.

In Arizona, Revised Statute §25-804 allows a parent to institute a paternity proceeding during a pregnancy.  It also requires that child support proceedings must be started before a child’s 18th birthday, except in unique circumstances.  A birth certificate with a father’s name on it is evidence of paternity in Arizona in a court of law, but is little more.  In order to prove beyond a doubt the identity of the father, an Order of Paternity may be sought by the presiding court.
