Schools Review Student and Teacher Drug Use Policies

Many U.S. school districts are reviewing policies regarding drug use to address student and teacher drug abuse.

WASHINGTON - Oct. 5, 2018 - PRLog -- U.S. schools are reviewing their drug use policies, particularly whether to incorporate drug testing for students and teachers. Some of the reasons for this include teacher violations and the national opioid epidemic.

The debate surrounding drug testing students has been a concern for decades, even being settled by the U.S. Supreme Court. A 1995 case ruled random drug testing was admissible for student athletes. A following 2002 case expanded that ruling to include all middle and high school students engaged in competitive extracurricular activities.

That ruling doesn't affect private schools, however.

When a case against the District of Columbia was heard in 2016 regarding privacy rights and warranted searches in accordance with the Fourth Amendment, an association of more than 70 private schools won the lawsuit. Teachers were then not required to be subjected to random drug tests.

Many educational entities and school districts have set employment guidelines, especially regarding drug use. Some may only require a drug test for an employment screening, while others require them throughout an individual's employment term. Others have clauses that call for termination is an employee is convicted of a drug felony.
