By: Netzealous -MentorHealth Fremont, CA: MentorHealth, a provider of professional trainings for all aspects of the healthcare industry, will organize a webinar on October 7. The topic of this webinar is “Healthcare Marketing: Beyond the Anti-Kickback Statute and the Regulations” About the webinar: This session deals with the ways in which healthcare organizations need to perceive and implement provisions of the Anti-Kickback Statute (AKS). For more information or to register for the webinar, please click here. The AKS being what it is, namely extremely generic and broad; it is imperative for healthcare organizations to get to the root of the provisions governing their marketing conduct. One false step at marketing can lead to numerous issues that land the organization in all kinds of problems. The penalties for not conducting a marketing program correctly can be severe, including exclusion, civil monetary penalties and even criminal prosecution. The speaker will examine the “safe harbors” and cover an in-depth overview of OIG guidance and advisory opinions dealing with marketing activities, as well as a review of case law regarding marketing behavior. He will also critique the case law, OIG advisory opinions, and OIG compliance guidance. This will help participants understand what they can and cannot do with engaging in healthcare marketing. At the end of this session, participants will have gained a sound understanding of what can and cannot be done with regard to marketing activities. The speaker will review various cases to show how easy it is to run afoul of the Statute, and how the courts view compliance with it.
