PRLog -- The Incident which is the subject of the instant Complaint took place at or about noon on April 7, 2015, as Ricky was inside a Bodega at the corner of Clarendon Road and Flatbush Avenue in Brooklyn, NY. As he was using the ATM machine inside the Bodega, two (2) NYPD Officers grabbed him and started searching his person. The officers then demanded Ricky’s identification which he produced. Back-up was called for and both a marked NYPD cruiser and an unmarked police vehicle arrived on the scene.
One of the officers that had just arrived began teasing Ricky that the sneakers he was wearing were ‘fake Michael Jordan’s,’
and Ricky responded that they were real. Another NYPD Officer that had just arrived then told Ricky that he would be going down to the precinct because the officer felt like putting him ‘through the system.’ Plaintiff was then handcuffed and transported to the 70
th Precinct. Once at the precinct, Ricky asked to call his lawyer, but his request was denied. After spending approximately nine (9) hours at the precinct, Ricky was taken to Central Booking to await arraignment. Following a twenty-two (22) hour detention, he was arraigned in criminal court and charged with two counts of obstructing governmental administration (OGA), two counts of disorderly conduct and a health code violation.
