Litigation News – Settlement of Slip and Fall Claim

NEW YORK - Feb. 8, 2014 - PRLog -- Stuart DiMartini, a veteran New York City personal injury lawyer has settled a claim for injuries arising from a slip and fall accident.

In this case, the property owner altered its premises to allow water drainage directly onto the public sidewalk.  According to DiMartini, the water froze over “creating a dangerous slipping condition.”  DiMartini’s client slipped on the icy condition sustaining serious injuries.
The insurance company for the property owner sought to disclaim coverage, which would have left the premises uninsured.  The disclaimer was defeated in the Supreme Court, Kings County.
With coverage available, DiMartini was then able to successful settle the claim for his client.
