A tort is when a person or entity wrongfully injures another person or damages another's property. There are three elements that a personal injury lawyer must be able to establish before an injured party can recover civil damages based on tort. The lawyer must establish that the wrongdoer was under some legal duty, breached that duty and thereby caused damages to another party. DiMartini said, "I believe it is important to keep the public, in general, and those injured in accidents, in particular, informed of their rights and how the process works. That is why I publish free eBooks. Many people don't understand that simply because they were hurt, they are not automatically entitled to civil damages. There are requirements under the law that be established and proven first."
