Burn Lawsuit Filed Against The Melting Pot On Behalf Of Customer Injured By Careless Employee

 
WESTON, Fla. - Nov. 5, 2013 - PRLog -- The Law Offices of Jason Turchin announces the filing of a lawsuit against The Melting Pot on behalf of a customer who suffered severe burns to his arms after a waiter allegedly spilled boiling liquid on him while removing a fondue pot from the table. The lawsuit, filed on behalf of victim Gustavo Pares in the 11th Circuit Court in and for Miami-Dade County, Florida, Case No. 2013-29613-CA-01, alleges The Melting Pot and its employee failed to use reasonable care, failed to maintain the subject premises, allowed an unreasonably dangerous condition to exist on their property, failed to properly and/or reasonably train its employees, and negligently operated their business so as to create a substantial and unreasonable risk of harm to the customers invited into their business.

Named in the lawsuit are The Melting Pot Restaurants, Inc. and franchisee Daisylo, LLC d/b/a The Melting Pot.  Documents produced by The Melting Pot show that all servers were required to use a contraption called a “Roemmelator” to safely transport pots of hot oil and other liquids. The lawsuit alleges that the employee failed to properly secure the “Roemmelator” on the pot, allowing burning hot oil to splash on the victim.

"This was a clearly preventable and foreseeable incident," says Attorney Jason Turchin.  "We fully intend on proving that The Melting Pot's employee was negligent and that the restaurant failed to properly and adequately train their employee," adds Turchin.

The lawsuit seeks unspecified damages greater than $15,000.00. According to Turchin, "we intend on seeking damages for our client's past and futures medical expenses, past and future pain and suffering, other compensatory damages, and punitive damages for what we believe was gross negligence by their employee."

The Melting Pot has denied wrongdoing according to their response to the lawsuit. Turchin contends, "It is irresponsible and mind-boggling that their employee can be clearly negligent and injure an innocent victim and customer, yet The Melting Pot refuses to take responsibility. We are going to fight for our client's rights against this corporation to pursue justice for our client."
