Defending a Claim

If you dispute a claim which has been made against you, you have 14 days after service of the claim on you (or 14 days after service of separate detailed particulars of claim) in which to file a defence.

If you need more time to seek advice to complete your defence, you may file an acknowledgment of service with the court within 14 days of service of the claim.  This will give you a further 14 days in which to file a defence, i.e. a total of 28 days from the service of the claim on you.  

An acknowledgment of service can be used to indicate that you intend to defend the claim but need more time to file your defence; and also whether you intend to contest the court’s jurisdiction.  In this context, jurisdiction does not refer to geographical location; it means that you believe the court does not have the legal authority to hear the claim made against you.
