June 28, 2011 - PRLog -- Plaintiff, an 18-year old boilermaker, was rear-ended by an 18-Wheeler while traveling eastbound on Interstate 10 in Baton Rouge.  There was only minor damage to the plaintiff’s vehicle.  As a result of the collision, plaintiff argued that he sustained a bulging or small herniated disc in his lumbar spine.  The defendants contested the presence of a herniated disc, as well as causation.  Defendants argued that any disc injury that may exist was caused by a prior accident that had recently occurred where the plaintiff had been ejected from his vehicle.  Plaintiff received conservative care for his injuries which included medications, physical therapy, and epidural steroid injections.  Plaintiff argued that his pain had become chronic and would require future medical treatment.  Past medical expenses were $29,000.  The case was settled at mediation for $350,000.00
