EXAMPLE A delivers his money to his brother for safe custody for 2 months. This will be bailment for safe custody 1. FOR EXCLUSIVE BENEFIT OF.THE BAILEE Sometimes the goods are delivered only for exclusive benefit of the bailee. EXAMPLE A gives his pen to B for using in examination Here the bailment is for the sole benefit of bailee 1 FOR MUTUAl BENIFIT OF BAILOR AND BAILEE Bailment for the mutual benefit of bailor and bailee . is the most common type of bailment EXAMPLE A delivers his walch to B for repair purpose with payment of repair charges. Here the benefit is of both panics (B) BAILMENT FROM REWARED POINT OF VIEW It is one in which neither party is entitle to any remuneration. EXAMPLE A lends his pen or B without any charge. BAILMENT It is the one in which either bailor or bailee is entitled to a remuneration. EXAMPLE A gives his cloth to a tailor for making the shirt. THE BAILMENT IN LEGAL SENSE Bailment means a legal relation tfiat arises wiien one person give his property to any other person for some. specific purpose under an agreement and that person return • the identical property to the former after charging charges. N8 of the contract act J872 "A bailment i& the del/very of goods by one person) another for some purpose, upon a contract that they shall when the purpose is accomplished, be returned or otherwise disposed of according to the directions of the person delivering them " 3. ACCORDING TO A*C. SABRE Bailment is the delivery of goods by one person called [he bailor to another, called the bailee on the condition that same goods shall be redelivered by the bailee to or on the directions of the bailor " • EXAMPLE I) "A" gives his watch to "B" for repair. il) "A" gives his cloth to "B" a tailor for making a suit. In borh cases "A" is the bailor and "B" Is the bailee. PARTIES There are two parties to the contract of bailment 1. BAILOR s- The person who delivers the goods is called the bailor 2. BAILEE f The person to whom the goods are delivered is called the bailee RIGHTS OF 1, RETURN The bailor has a right to get back the goods bailed by him as soon as the purpose of bailment is accomplished. If the bailee fails to do so the bailor is entitled to get reasonable charges from the bailee. EXAMPLE A gives his watch to B for the repair purpose; After repairing the watch and clearing the payment of* repair charges, A will be entitle to get back the watch. 2. UNAUTHORISED USEOF GOODS The bailor has a right to terminate the contract of bailment if bailee makes the unauthorized use of goods bailed and he has a right to recover any Loss arising to the goods due to such use. EXAMPLE A gives his motor cycle for repairing purpose to B. But B started to use it without A's permission. So here A can terminate the contract of bailment and also can demand for damages if there is any loss to motor cycle. 3. CARE OF GOODS The bailor has a right to recover the damages from the bailee if the bailee does nor make the proper care of goods. EXAMPLE A bails his motor cycle to B for repair. B omits TO lock the motor cycle. 1 he motor cycle is stolen. B is liable. 4. ^REMUNERATION The bailor has a right to receive the remuneratior agreed in the contract of bailment. 5. CLAIM INCREASE OR PROFIT Bailor has right to claim any increase or profit which may have accrued from the goods bailed. EXAMPLE A leaves a cow in the custody of B to be taken cm of The cow gave a birth ro a child. A has a right to take :he child as well as cow from B. 6t __ COMPEffgATlON If the bailee without (he consent of the bailor mixes the goods of the bailor with his own goods in such manner that it becomes impossible to separate them.
