The clients were located all across the country, but all had one thing in common: the inability to repay their IRS tax debts. To stop collections, Roni’s team of tax attorneys successfully negotiated with the IRS on behalf of these taxpayers and had their IRS collection accounts placed into a Currently Not Collectible status.

Currently Not Collectible status is a designation the IRS uses to indicate that it cannot collect from a particular taxpayer at that time. Once placed into Currently Not Collectible status, the IRS no longer attempts to actively collect on the debt and the taxpayer is not required to make any payment on the debt.

Typically, the IRS places a taxpayer's collection account into Currently Not Collectible status only after determining that the taxpayer cannot pay his or her back tax liability in full or does not qualify for a monthly payment plan because his or her income is exceeded by his or her expenses. To determine whether a taxpayer can pay in full or through monthly payments, the IRS reviews the taxpayer’s monthly income and expenses, as well as the value of his or her assets. If the IRS sees that the taxpayer is barely scraping by with his or her income and necessary living expenses, they will place them into Currently Not Collectible status, which is intended to be temporary.

Interest and penalties continue to accrue on the tax debt, and the taxpayer is often subject to a federal tax lien and annual review of their financial situation. However, if the taxpayer’s financial situation does not improve in the coming years, the taxpayer can remain in a Currently Not Collectible status indefinitely and until the underlying tax debt expires.
