Maine Judicial Branch FY15 Annual Report Shows Every Eviction Violated 7th Amendment
 
AUGUSTA, Maine - May 7, 2016 - PRLog -- According to two civil rights lawsuits filed on February 11 and 16, 2016 in GinA v. Leigh Saufley et al, 1:16-cv-00095-NT, and GinA v. City of Augusta et al, 1:16-cv-00100-NT, in the United States District Court for the District of Maine, GinA alleges all evictions in Maine happen without a trial by jury in violation of the 1st, 7th and 14th Amendments to the Constitution.

Statistical data on Page 2 of the Maine Judicial Branch's Annual Report for FY15 found here:  https://www.scribd.com/doc/311834575/ar2015 proves GinA's allegations by showing 6,177 FEDs (evictions) were ordered in District Court during fiscal year 2015 in a summary process with zero FEDs heard in superior court. Historical court data further supports GinA's allegations by showing all Maine FEDs for FY10-FY14 were ordered during a summary process in District Court with no trial by jury.

What's most alarming, however, is the increased frequency of these unconstitutional acts.

GinA's complaint at items #19 and #20 on Pages 34-35 provide data for FY10 - FY15 which "shows a 35% spike in district court evictions for FY10-FY15: FY10 - 4,717, FY11 - 5,162, FY12 - 5,352, FY13 - 5,702, FY14 - 6,076, FY15 - 6,177. All Maine evictions from FY10 through FY15 were ordered in a Rule 80D summary process pursuant to 14 MRSA §§ 6001 - 6030-E with no discovery and presided over by a single judge in a state district court."

What has happened to 7th Amendment protections during evictions in Maine?
