Mary Inman is a partner in Constantine Cannon’s San Francisco Office. She specializes in representing whistleblowers in “qui tam” lawsuits brought under the Federal and various state False Claims Acts.

Event Synopsis:

In 1863, the Congress enacted the False Claims Act (FCA), or Lincoln’s Law, to enable the federal government to sue individuals for fraudulent sale of supplies to the Union Army. Since then, the scope of FCA has been expanded, especially in application to the health care industry.

Companies now face increasingly high liability under this statute. For example, in 2009, the Department of Health and Human Services Office of Inspector General (OIG) determined that roughly 20% of all Medicare Part A skilled nursing facility claims were inflated to a higher 'RUG group' resulting in almost $1.2 billion in improper payments. Recently, another nursing home operator paid $48 Million to resolve allegations of fraudulent billing by 6 California facilities.

States have also passed their own False Claims Acts, to recover state (and in some cases, county and/or municipal) tax dollars as well. Most recently, in June 2015, Maryland expanded the scope of the Maryland False Claims Act (MFCA), previously limited to Medicaid and healthcare fraud, and now covering any claims made to the state or to local government. This follows similar enactments in Vermont and other states.

Relators and the government are pursuing and winning more complex FCA suits and are winning much more significant recoveries. Long term care providers and others need to be aware of the greatly increasing risk of serious legal and compliance challenges that will be upcoming.
