Such sequenced discovery focusing on cause is viewed as a suitable tactic in mass tort litigation. Commonly, such legal action is complicated and very expensive. To hedge their bets, many companies name numerous plaintiff firms to ensure success. This method inevitably leads to poor results or failure at significantly added cost. Without admissible evidence of general causation, the claims of a plaintiff fail and the defendant is entitled to summary judgment.
