NY Overtime Pay Lawsuit Results in $500,000.00 Settlement

NEW YORK - April 26, 2015 - PRLog -- On April 22, 2015, a federal judge in the Northern District of New York gave final approval of the settlement and certification of the settlment class in the matter of Gardner v. Kmart. The suit which resulted in the $500K settlement had alleged that KMart's New York Loss Prevention Managers were misclassified as exempt from overtime pay. As a result, the lawsuit claimed, the loss prevention managers were denied overtime pay for the hours that they worked in excess of forty in a workweek.

It is not uncommon for employers to give their employees fancy titles such as loss prevention manager, assistant manager, team leader, team coach or other titles to avoid paying overtime. The employer may claim that the employee with the fancy sounding title is salary exempt and therefore not entitled to getting time and a half for the time they work over forty hours in a workweek. However, it is important to know that titles do not always tell the whole story and most employees, regardless of title are entitled to overtime pay in NY.
