State Farm Settles with Car Accident Victim after Three Years

ATLANTA - Feb. 5, 2015 - PRLog -- An accident took place in February 2012 in Cherokee County when the victim was T-boned at an intersection when the other party ran a red light.  The victim’s Corvette suffered serious damage and the victim was seriously injured, sustaining nerve damage, incontinence, contusions, a concussion, and other harm.  After being released to a doctor’s care from Wellstar Kennestone Hospital, the victim became a client of Kalka & Baer who “met with me personally and took care of every aspect of my case,” according to them.

After agreeing to mediation within 90 days of Kalka & Baer filing a lawsuit, State Farm backed out the night before the mediation was due to begin.  This led to Kalka & Baer fighting State Farm for some three years, which included the latter hiring an expert to claim the incontinence suffered by the victim was unrelated to the accident.

After cross-examining the expert, however, Mr. Kalka was able to get them to admit that the incontinence may have indeed by caused by the accident.  In all, Kalka & Baer submitted four witness and five medical depositions, beating out State Farm’s Motion for Summary Judgment.

Finally, in January 2015, State Farm chose to settle with the victim.  Mr. Kalka noted “It was an uphill battle all the way, but a battle worth fighting.”
