NY Criminal Lawyer obtains ANOTHER ACQUITTAL

NEW YORK - Nov. 8, 2013 - PRLog -- Michael J. Redenburg's client, RJ, was accused of Forcible Touching and Sexual Abuse in the 3rd Degree. The facts of the case, according to the government, are disturbing considering that allegations such as these could conceivably be lodged against anyone riding the NYC subway trains. In this case, the government alleged that RJ boarded a crowded subway train and pressed his groin area against a female passenger. Attorney Redenburg's client denied the allegations and demanded a trial. For purposes of trial, the prosecutor reduced the charges to the lower count of Sexual Abuse in the 3rd Degree, a Class B Misdemeanor, for purposes of obtaining a bench trial, which is in front of a Judge only, no jury.

At the start of the trial, the prosecutor announced for the first time that the alleged "victim" would not be testifying and that only two NYC police officers would testify. The two NYC police officers thereafter testified as to what they claimed to have witnessed. Subsequently, RJ testified on his own behalf and controverted the police officers' testimony. The trial of the matter from start to finish, lasted about 1 HR and 45 MIN.; after opening statements, testimony from the NYPD agents, testimony from RJ and counsel's closing arguments, The Honorable Patricia Nunez decided that RJ was NOT GUILTY of the charges levied against him and Mr. Redenburg's client was acquitted.
