If you are looking to file for divorce in Broward, Miami or Monroe County without an attorney it’s important to understand the different types of divorce available and their requirements:

Simple Divorce – This is the type of divorce that can be filed when there are no minor children no joint property, assets or liabilities. This divorce can be done in mutual agreement, by summons or by publication (missing spouse). For a divorce in mutual agreement the following forms are required: Civil Coversheet, Petition, Notice of Related Cases, Notice of Social Security for both parties, Family Law Financial Affidavit for both parties, Certificate of Compliance for both Parties; Final Judgment and Notice of Hearing. If the divorce is not in mutual agreement then a summons must be submitted and a process server or sheriff must serve the papers to the other party.  If the address for the other party is unknown then a Notice of Action for Dissolution of Marriage must be published is a newspaper for 30 days prior to requesting a hearing for the final judgment.

Divorce with Property – In this divorce the paperwork is the same as the simple divorce with the addition of a Marital Settlement Agreement.

Divorce with Children – In this divorce the paperwork is the same as a Divorce with Property but with the addition of the Child Support Guidelines and the Parenting Plan.
