The decision overruled a determination by the Department of Labor that the employee was not entitled to unemployment insurance benefits and must repay all money received. Specifically, the decision set forth the following: DECISION: The initial determinations charging the claimant with an overpayment...recoverable pursuant to Labor Law Section 597 (4)...on the basis the claimant made a willful misrepresentation to obtain benefits, are overruled.
