Hearing Judge issues award in favor of Imbesi Christensen client charged with misrepresentation
The law firm of Imbesi Christensen received notification of an award issued in favor of the firm's client who was terminated by National Wholesale Liquidators. See A.L.J Case No. 013-20377
The Honorable Craig Fishkin issued an award, in favor of the firm's client, after an in-person hearing was conducted. The decision overruled a determination by the Department of Labor that the employee was not entitled to unemployment insurance benefits and must repay all money received.
Specifically, the decision set forth the following:
DECISION: The initial determinations charging the claimant with an overpayment...recoverable pursuant to Labor Law Section 597 (4)...on the basis the claimant made a willful misrepresentation to obtain benefits, are overruled.
The claimant is allowed benefits with respect to the issues decided herein
