People often ask me about the work I do as a professional process server. The interesting stories, the people I meet.
Invariably, though, what piques their interest the most is when I talk about our role in preserving due process rights. It might sound high and mighty at first, but I’m proud to be in a profession that not only plays a role in ensuring fair and equitable treatment under the law, but is committed enough to it to sponsor this, the first National Due Process Day.
As a member of the National Association of Professional Process Servers, I am obligated to abide by a strict set of standards and best practices, but what it really comes down to is protecting the due process rights of persons affected by our service. If we fail to do our jobs correctly, legal cases can be delayed or dismissed, and the legal system we all value and cherish becomes compromised.
Technically speaking, due process is protected by the Fifth and 14th Amendments. But on a practical day-in, day-out perspective, it is carried out by legal professionals – from law enforcement to notaries to lawyers and judges – committed to making sure that every American is treated fairly and equitably under the law.
Anything less than the highest level of professionalism can cause a breakdown in the system – a system our Founding Fathers had the foresight to envision and insist on. They were escaping tyranny when they declared their independence, and it is why we take our jobs so seriously.
It’s why, too, we need avoid letting our guard down when it comes to things that can challenge our due process rights.
In our business, for example, personal service of process is a core value we must insist on and not succumb to the convenience – and imperfections – of serving process via email, social media or other electronic means. As noted attorney Steven Teppler wrote recently in the National Law Review, despite technological advancements, “personal service of process remains the most reliable and efficacious way to both ensure compliance with due-process requirements of notice to a defendant and the opportunity to be heard.”
On this National Due Process Day, we ask you to join us in both commemorating the ideals set forth in the Fifth and 14th Amendments, and protecting those rights for our children, our grandchildren and beyond.
As a member of NAPPS and a member of your community, I thank you for your ongoing support.
