Florida Business Law Firm Wins Case for Not-for-Profit Organization

The case began when Oorah, Inc., a not-for-profit organization located in New York that provides a wide variety of activities and programs to give Jewish children and adults all throughout the area experience their heritage, turned to a Florida provider of steel buildings to assist in building a summer camp program. Oorah aimed to use this steel company to provide for their upcoming summer camp. The steel company, Turn Key Steel Buildings, Inc., sold itself to buyers as a leading provider for steel buildings for the purposes of agricultural, personal and business applications.

The case report shows that Oorah change its order twice and each order of change was generated and documented by the parties. Oorah and Turn Key Steel Buildings signed contracts and the not-for-profit company paid deposits to the steel company.  The issue arose between the organization and company when Turn Key Steel Buildings failed to deliver any steel building to Oorah. Oorah then demanded that Turn Key deliver the steel building or return the money that was deposited. When Turn Key failed to abide by either of these orders, an arbitration was filed by the attorneys representing Oorah. It was required that the contract disputes were arbitrated.

Attorneys Alex Rosenthal and Amanda Jassem Jones of Reimer & Rosenthal, LLP represented the not-for-profit company in front of the American Arbitration Association. At this meeting, the Florida business lawyers fought on behalf of Oorah, describing the breach in the contract and identifying Turn Key’s failures. When the arbitration hearing concluded, the arbitrator determined that Oorah should be awarded damages in the amount of $77,034.00 in addition to prejudgment interest in the amount of $8,294.00 and the arbitration costs of $4,495.00.

In the end, the Circuit Court for the 17th Judicial Circuit in Broward County, Florida reached a decision confirming that Oorah will be awarded a final judgment.  The arbitration award was confirmed on April 4, 2012 and the final judgment totaled to $89,823.00. The attorneys’ fees for Oorah were also awarded in the final outcome of the hearing.
