March 19, 2012 - PRLog -- Plaintiff (our client), a 52 year old recently divorced bookkeeper was at a stop light in Baton Rouge, Louisiana where she was rear ended by a defendant who was going less than approximately 10 miles per hour. Damage to the plaintiff’s vehicle was minor and neither airbags in either vehicle deployed.

Our client began to treat conservatively, but as defense counsel would later relentlessly argue, she had identical complaints of pain in her neck that she had from a previous, more serious accident just a few years before. MRI reports revealed disk bulges throughout her cervical spine. Our client's only new complaint was radiculopathy and decreased sensation in her hands and fingers. Plaintiff was forced to give up her job as a bookkeeper and was without income for several months.  She underwent a series of ESI's and physical therapy. Dr. Kevin McCarthy of the Baton Rouge Bone and Joint Clinic ultimately recommended a 4 level anterior fusion.

My client was prepared to argue that while she had very similar complaints to a previous accident, this most recent accident necessitated a surgery that was going to potentially change the plaintiff's lifestyle indefinitely. Plaintiff’s past medical expenses totaled $25,000.   The parties settled the matter for $350,000.
