By: BARRY I. BESSER, ESQ. Upon reviewing your last court order dealing with visitation with your children, determine whether circumstances have changed which may require a modification of that custody/visitation order. An example of changed circumstances would be that you or your "ex" have moved out of the local area since the last order, and now that order is not practical any longer. If that is the case, and you are on speaking terms with your "ex", try to contact them directly to work out an arrangement that works well for both of you. If you are not on speaking terms, or have had trouble working out visitation in the past, you will need to file an Order to Show Cause with the court for a modification of the last court order. You are also going to want to see if your holiday visitation falls on the time normally designated for the other party. Generally speaking, holiday visitation supersedes the regular visitation schedule, so you will want to take a close look at your current court order in that regard. Always bear in mind, that both parties should always be looking at what is in the best interest of the children, and make whatever transitions that are made, as smooth as possible. Remember, don't wait until the last minute to deal with these issues, as it may then be too late to deal with that particular holiday. Lastly, remember that cooperation is less costly than litigation.
