By definition, fixtures must stay as they are part of the real estate. A fixture could be described as such items as ceiling fans, light fixtures, and switch plates. A deck on the house should not be dismantled and removed as it is a fixture and belongs to the house.

Sometimes people upset with the bank for foreclosing on them do destructive things to their homes before they leave. They have been known to tear out walls to get the pipes and copper to sell for scrap. Those items are not personal property. They are fixtures and must be left with the house. Taking out the fixtures or causing retaliatory damage can bring the insurance company down on you.

When the bank takes possession of the house and finds that things are missing or have been vandalized or damaged, they will file a claim with the homeowner’s insurance. Those that are angry with the bank may not realize that the bank will not be affected by the vandalism. The insurance company must pay for the damage but will come after those that inflicted it. The new homeowner will have to fix everything if the house is bought as is.

The items that must be left with the house include the doors and cabinets, built in appliances, furnaces and air conditioners, plumbing and electrical lines, light fixtures, ceiling fans, windows, shelving that is built in, landscaping, fences, spas and pools if built in, and bathroom fixtures like the sinks and tubs, toilets, and showers.

Items that can be taken out of the house include personal items like clothing and possessions that you moved in with you, furniture, household items, area rugs, plants in pots, and electrical appliances that aren’t built in. Be sure to take them when you leave the house or you could be charged for the storage if they have to remove them.

If you have to leave your home through foreclosure, take only what you can legally remove and what is yours. Leave the fixtures for the next owner as that is the legal way to leave the house. You will move on with a fresh start.
