By: Steve Dibert The suit alleges that Orlans and Associates improperly sold the mortgage and note to Fannie Mae and Marshall Isaacs then improperly issued and filed a Sheriff’s Deed for the property to Fannie Mae as if Fannie Mae was the owner. The suit also alleges that BAC through its representatives as well as a local housing authority told Ms. Lucas to stop making payments on her mortgage in order to “qualify” her for a loan modification. The loan modification BAC offered her increased her payment by 50% and increased her principal balance to the full amount owed and was not a modification under any federal or state program. The lawsuit alleges that instead this was an attempt to collect the full amount owed and was in direct opposition of what she was told by BAC representatives when they instructed her that the only way to facilitate a lower payment and lower principal was to stop making the payment. “Unfortunately, the agony my client had to endure by Bank of America and these lawyers is not uncommon,” said Steve Dibert, Owner of MFI-Miami, LLC, “Millions of Americans have become victims of an out of control banking industry, negligent attorneys and an overworked court system.
