The patent, filed in 2000, is titled “Digital Network Processor-Based Multi-Protocol Flow Control” and was originally assigned to BBN Technologies Corp.; however, the current assignee named on the patent is Stragent. Based in Longview, Texas, Stragent develops, acquires, and licenses patent technology. The complaint states that the defendants, Huawei and Futurwei, have been and are currently infringing and inducing infringements by others as well as contributing to the infringement of others. Stragent is accusing the defendants of, “among other things, making, using, offering for sale, and or selling… and or importing… microprocessors, including without limitation Huawei Quidway Router products.” Huawei is based in Shenzhen, China and offers seven versions of their Quidway Router. All of which claim to be “high-end network products”. Huawei and Futurewei are telecom solutions providers and are owned entirely by their employees. They offer telecom network infrastructure, application and software, as well as devices and professional services. An independent report on patent ‘753 by Patent Calls states that there could be prior art that may invalidate Stragent’s patent, “No specific prior art has been identified to invalidate the subject patent. However, network traffic control is a large issue as the use of the Internet has dramatically increased over the last 20 years. Thus, the field is likely to be crowded with a large amount of prior art that could potentially yield invalidity arguments towards the broader claims.” Stragent is asking to be awarded damages, costs, and expenses, as well as pre and post judgment interests. All parties involved in the complaint were contacted for comment, none responded by press time. In September 2008, Stragent filed a complaint against Microsoft and Ford for infringement on US Patent 7,424,431, titled “System, Method and Computer Program Product for Adding Voice Activation and Voice Control to a Media Player”.
