It is important to know what compensation you can claim if you become ill on holiday or suffer an accident on holiday through no fault of your own.

In addition to compensation for your pain and suffering (known as General Damages) you can claim your financial expenses and losses (known as Special Damage) from your tour operator.

Loss of Holiday Bargain

This may be claimed if your illness has prevented you from using the hotel’s restaurant or your injury has stopped you from using the hotel’s swimming pool. Care

Though you probably will not have paid for care and assistance during the period you were ill or injured the law allows you to recover compensation for the notional cost of care provided by relatives or friends. For example if you could not carry out housework because of your injury and had to rely on family members to do your chores you can claim compensation for the care you received from family and friends as a consequence of your injury

Any costs you incur for medical treatment can also be claimed as can incidental expenses that relate to your accident or illness. You may have incurred taxi fares to and from a hospital or an insurance policy excess payment. These are examples of expenses and the list is not exhaustible.
