The offending homeowner may not realize they have done anything to upset their neighbor unless they are informed there is a problem."

Homeowners should review HOA rules to understand what behaviors and actions are permissible and what are not, says Kuester. Keep a written log of when the actions occurred, what was said and done, and anyone else that witnessed the situation. If possible, take pictures or videos to document damage or harassment.

Bring up any concerns to the board so they are aware of the situation and can determine if they need to intervene. Violations of HOA rules are something the board should address in a timely and appropriate manner. Baseless claims or behaviors that do not break any rules may be left to homeowners to resolve between themselves. The board may also consult with its legal counsel for insight on how to best proceed or offer mediation for dispute resolution.

"Members who feel threatened or in danger should contact law enforcement," says Kuester. "Sometimes legal action is necessary for unwanted behaviors or harassment to cease. The HOA should have clear rules and expectations in place – and be consistent in enforcing them – to help prevent problems and create a safer, more enjoyable living environment for everyone."
