"One way to be proactive regarding noise is to provide regular reminders about HOA policies such as quiet hours or what is considered a nuisance," says Bryan Kuester, President of Kuester Management Group. "It can be helpful to provide specific examples to give members a better understanding of what is or is not acceptable. And be fair and consistent when it comes to enforcing those rules."
It should be clear that everyone is being held to the same expectations and no one is receiving special treatment, says Kuester. Encourage members to talk to their neighbors if there are concerns about noise before filing a complaint. The person may not have realized they were causing a disturbance or annoying their neighbor. Many disputes can be resolved through polite conversation.
If talking did not help, make sure members know how and where to file a formal complaint with the HOA board. The board should review any complaints to determine if a violation occurred and how to proceed. Talking to both neighbors and mediating the situation can lead to a swift resolution and help prevent future issues. In some cases, the HOA may need to consult with its legal counsel if the problem cannot be resolved.
