SEATTLE - Sept. 28, 2021 - PRLog -- Factimize issues Cease‐and‐Desist Demand
SEATTLE—Factimize PatternViewer (aka EVDense Holding Co., Inc.) has issued a Cease‐and‐Desist letter to a North Carolina company, citing infringement of its patented digital record and visual representation systems.
The demand calling for a halt to the infringement was issued on Sept. 13 to Dorcy Pruter, chief executive officer of Dorcy Inc., and her Raleigh‐ based Conscious Co‐Parenting Institute.
Factimize assists clients in high‐conflict divorce cases and contested business matters by creating precisely detailed records of written and electronic communications. It supplements its reports with highly specialized graphic presentations of the records.
The Cease‐and‐Desist demand threatens Pruter with court action of she fails to heed its demands.
"(Factimize) takes its intellectual property rights very seriously and is committed to their protection," attorney Paul Tomita of Staniford Tomita writes in the letter. "While (Factimize) prefers to come to a business resolution thereby avoiding litigation … it will not permit infringement to go unaddressed."
Founded in Seattle in 2010, Factimize (fka HCI PatternViewer) holds a patent issued in 2016 for its PatternViewer system of digital data storage, timeline and visual representation customized to analyze data and identify patterns.
The Cease‐and‐Desist demands contends Pruter has wantonly copied the systems Factimize has marketed since 2010, and that she has been selling them through her Conscious Co‐Parenting Institute since 2017.
It further calls on Dorcy Inc. to immediately halt the sale of the Custody Resolution Method's digital timeline and provide an accounting of all such sales.
"We expect the provision of the accounting report to include customer and invoice information for all sales and distribution of the Customer Resolution Method digital timeline," Factimize said in its letter, which demands compliance by Sept. 30.
