Massive Copyright Infringement by Amazon et al

Stay Frosty Enterprises a small veteran owned and operated business provides the brave individuals of the US military, fire and police with clothing and gifts worthy of those that served. Stay Frosty is officially licensed by the US Military and Popeye the Sailor.

In quarter 1 of 2016 Stay Frosty notice a sudden and unexpected drop in sales. Upon research it was discovered that many companies had stolen Stay Frosty's Federally Copyrighted designs. Amazon was one of these companies.

PORTLAND, Ore. - Jan. 31, 2019 - PRLog -- Small Veteran-Owned Business Slings a Stone at Giant Corporations

Q1 of 2018 Stay Frosty Enterprises, LLC filed suit against Amazon.com, Inc. in Seattle Washington; Teespring.com in San Francisco, CA; Sunfrog, LLC, et al for copyright infringement from their online store Vision-Strike-Wear.com with nearly 100 federally copyrighted and over 300 in copyrighted intellectual properties.

This is one of the largest copyright infringements for a plaintiff to be filed in the United States!

In 2015 Stay Frosty added many designs to its online store that summer---within weeks they were being sold on Amazon and many other sites.  Unbeknownst of this; Vision-Strike-Wear traffic and sales diminished.  After the previous year of growth with new and original cutting-edge designs for the military, exclusive only at Stay Frosty Enterprises, sales reversed course. Something was wrong. It would take another 2 years to find out why.

How could this be?  Vision-Strike-Wear.com had been serving the military since 2008, creating over 1600 custom art and shirt design requests from actual military units going on deployment or coming home during the height of Operation Iraqi Freedom and Operation Enduring Freedom.  VSW had been creating military graphics for custom requests from active duty troops in the Army, Navy, Air Force, Marines and Coast Guard. In 2014 Vision-Strike-Wear.com decided to tests the waters of the online retail market.  The future looked very bright for this small veteran-owned and operated company who was bringing new and amazing military designs to those who deserve only the best!  That is, until later that year the carpet was pulled out from underneath them when "big business" swooped in with huge marketing budgets and dominating online presence, thwarting any attempt for a small business to participate in a fair marketplace.

Seems like all these big corporations have something in common with 100,000's of active duty military personnel;  They love Vision-Strike-Wear's military graphic designs!

So much that for the following 2 years Stay Frosty would be spending precious limited man hours that could have gone to building their own company to track down anyone selling their designs and why sales plummeted.  Unfortunately, realizing how large and significant the impact was would not be clear until the fall of 2017, after discovering both Amazon and Teespring were selling hundreds of Vision-Strike-Wear designs and had been for years.

Now, Stay Frosty Enterprises struggles to compete against itself, against the Goliaths of the industry. Perhaps this lawsuit will be the "stone" that slays the giants and allows a small innovative AMERICAN-MADE business to compete in the immoral and unethical desert of today's online retail industry.
