In a lawsuit currently pending in the United States involving free trade issues, SmartBuyGlasses has filed counterclaims against Maui Jim for defamation, violation of the Sherman Anti-Trust Act, violation of Article 101 of the European Union Treaty, unjust enrichment and trade disparagement. The counterclaims allege Maui Jim engaged in numerous anti-competitive actions in direct violation of, among other things, the First Sale Doctrine, a landmark U.S. free trade law that supports the free movement of authentic goods. Remedies requested by the counterclaim include an award of financial relief to SmartBuyGlasses caused by Maui Jim's alleged violations.
