Predictive coding is the use of software program to identify relevant documents for a particular case or issue. It is a system that involves a machine learning process and applies complex algorithms to analyze data, review decisions for risk assessment, and make future predictions. The rise of predictive coding is dramatically reducing costs and time usually involved in electronic discovery. It also minimizes inconsistencies in large document review, helps identify more relevant documents, and substantially reduces risks of false accusations.

Nicholas M. Pace, a long-time RAND analyst, has contributed his expertise in justice-related research methodologies to many RAND Institute for Civil Justice (ICJ) projects, most recently leading studies examining expenses incurred during pre-trial discovery involving electronically-stored information and recommending steps to reduce costs; discussing transparency issues in class action settlements; and describing the features of class litigation against insurers.  Other work has included examining the impact of statutory reforms on outcomes in medical malpractice cases; leading a comprehensive study of the California workers' compensation courts; studying class action litigation dynamics and recommending new managerial approaches for judges in such cases; helping to accomplish an in-depth evaluation of the Civil Justice Reform Act of 1990 and its effects on judicial case management, cost, and delay; analyzing punitive damage awards; developing national standards related to electronic filing in the courts; and leading a study of attorney time expenditures for publicly-funded defense counsel in Federal district courts.
