Follow on Google News | ![]() Queens Man Alleges Overtime Pay Violations by Sir Grout FranchiseeA Queens man has sued his former employer alleging that the employer engaged in an impermissible compensation scheme, which systematically deprived him of overtime pay premiums for hours worked in excess of forty (40) per workweek
The Complaint goes on to allege that the former employee was regularly tasked with grouting, re-grouting and cleaning the grout within customer's bathrooms. The employer provided him with a company van, equipment and supplies, instructions concerning when to have the company vehicle's oil changed, a company credit card and a Sir Grout shirt and name badge to be worn while working inside of customer's homes. From time to time, the former employee was also required to go to Home Depot to pick-up supplies for the jobs to be completed, before going to the customer's homes in the morning. Throughout the course of his employment, the former employee regularly worked 55-70 hours per week, without receiving overtime pay premiums for all hours worked in excess of forty in a workweek. Rather than paying the former employee overtime pay as required by law, the Sir Grout franchisee concocted an illegal payment scheme whereby he paid the former employee $125/per day, regardless of the amount of hours worked, or, alternatively, a percentage of the total job amount. The former employee is seeking an award of all overtime pay owed plus liquidated damages (double the amount owed), damages for failure to provide accurate wage statements and notices as required by law, attorneys' fees and costs along with statutory interest.
