| ![]() Settlement Reached for Client Who Alleged Discrimination Based on Past ConvictionAfter the client started working for the employer, the employer notified the client that he would have to be let go from the company because of a particular type of felony conviction from 22 years ago that was uncovered in the background check the employer ran. Thereafter, the client filed a complaint with the New York State Division of Human Rights alleging discrimination and an unlawful discriminatory practice relating to employment because of conviction record in violation of N.Y. Exec. Law Article 15, Human Rights Law. According to the New York Human Rights Law, it shall be an unlawful discriminatory practice for any person, agency, bureau, corporation or association, including the state and any political subdivision thereof, to deny any license or employment to any individual by reason of his or her having been convicted of one or more criminal offenses, or by reason of a finding of a lack of "good moral character" which is based upon his or her having been convicted of one or more criminal offenses, where such denial is in violation of the provisions of Article 23(a) of the correction law.
