Settlement Reached for Client Who Alleged Discrimination Based on Past Conviction

NEW YORK - Sept. 24, 2015 - PRLog -- In the case of the client who retained Michael Redenburg, Esq., the client had applied for a job with a company located in New York City. The owner of the company interviewed the client and there was a discussion about how they had both had trouble in the past. The client also let the owner of the company know that the "trouble" in the past had lead to incarceration and a felony on his record. Thereafter, the client was provided with a date to commence his employment with the company and the client also completed an application and noted that he had a felony conviction. The client also understood that there would be a background check done.

After the client started working for the employer, the employer notified the client that he would have to be let go from the company because of a particular type of felony conviction from 22 years ago that was uncovered in the background check the employer ran. Thereafter, the client filed a complaint with the New York State Division of Human Rights alleging discrimination and an unlawful discriminatory practice relating to employment because of conviction record in violation of N.Y. Exec. Law Article 15, Human Rights Law.

According to the New York Human Rights Law, it shall be an unlawful discriminatory practice for any person, agency, bureau, corporation or association, including the state and any political subdivision thereof, to deny any license or employment to any individual by reason of his or her having been convicted of one or more criminal offenses, or by reason of a finding of a lack of "good moral character" which is based upon his or her having been convicted of one or more criminal offenses, where such denial is in violation of the provisions of Article 23(a) of the correction law.

Michael Redenburg represented the client and obtained a five figure settlement on the client's behalf. Attorney Redenburg also continues to represent workers who are denied overtime pay and currently represents three carpenters who were not paid prevailing wages and supplemental benefits on public works construction projects.
