| ![]() Former Chipotle Worker Entitled to Unemployment Insurance Benefits After Hearing HeldChipotle had initially contested the former service manager's entitlement to receive her New York Unemployment Insurance Benefits because a post to her Facebook account had been made that said the employer cared more about money than it cared about its workers. This post was made after Chipotle insisted the former employee go to work on a day when a severe snow storm caused the public transportation system to be shut down. The former Chipotle service manager testified that her boyfriend had caused the post in her Facebook account to be made and that she had given him her Facebook password because they dated for a long time. Another Chipotle employee saw the post and told the manager, who fired the service manager. The administrative law judge determined that the service manager was discharged because the employer deemed a posting on her Facebook page to have violated its social media policy. The judge also held that she did not post the rant on her facebook page and she took it down as soon as she became aware of it. Finally, the judge ruled that the former Chipotle service manager's actions did not constitute misconduct within the meaning of the unemployment insurance law and that her employment ended under non-disqualifying conditions. Therefore, she was allowed benefits.
