Fight Against DUI/DWI Offenses and Marijuana Possession Charges From Labor Day Weekend

Every year there is a substantial growth in the number of drug and alcohol offenders during the Labor Day Weekend and because the law enforcements crackdown during the last couple weeks of summer, there is always a lot of unfair tickets. The officer will administer several tests such as a sobriety test or a blood alcohol test. These are standard examinations that are used in a suspected DWI or DUI offense. Refusal of any of these tests, essentially is no different than admitting guilt. After the date of conviction, a DMV hearing can be scheduled within 10 days in order to fight the charge and remove the license suspension.

Unlike drunken driving, no blood test will be done for marijuana users. Though there is no scientific evidence of marijuana impairing a person’s driving capability, it is considered as a misdemeanor offense. The test conducted to detect the trace of marijuana in the body is not very accurate because traces of the drug can stay in the body days after using it. So a person who may not be under the influence of drugs can be in trouble if ordered to a random check.

If convicted with a drug or alcohol crime, there will now be a criminal record on the person’s name. The law protects patients who possess and use medical marijuana. If a qualified patient and charged with marijuana possession and/or driving while impaired, with the help of an attorney, they can prove your innocence.

It is IMPORTANT to write down as much that can remembered regarding the arrest, from an hour prior to an hour after. Every little detail is important and could possible change the outcome of the case. Important things to note: exactly what the officer has said, exactly what was said to the officer, tests that were performed, the percentage of the breathalyzer, the time of day, the location, were there any passengers, etc.
