Shannon Bates, executive partner with Klemchuk Kubasta, served as Co-Course Director and welcomed  the group of 90 attorneys to the two-day event.  Bates, a recognized IP and patent attorney, planned and managed the Continuing Legal Education program, which gave attendees access to legal experts that covered over 20 current topics on patent litigation.

“The annual Patent Litigation CLE gives our attendees the opportunity to stay on top of the latest IP legal trends,” said Bates.  “The programs this year focuses on management of patent litigation under the AIA Transition, managing claim construction determination across multiple cases, new Inter Partes review and interplay with litigation and construing the claims construction.”

Casey Griffith, senior partner with Klemchuk Kubasta practicing in all areas of intellectual property, with a concentration on litigation of patents, trademarks, copyrights and trade secrets made a presentation entitled, “Indirect and Direct Infringement after Akamai.”  The presentation discussed issues regarding the Federal Circuit’s en banc decision in Akamai Techs., Inc. v. Limelight Networks, Inc., including how that decision affects potential liability for inducing patent infringement and direct infringement.  “This subject matter is important to course attendees and patent litigators because the decision greatly expanded potential liability for inducing patent infringement”, said Griffith.  “The dissents also suggest the possibility that vicarious liability for direct infringement could be allowed in circumstances beyond the existing ‘direction of control’ standard.”
