FLSA establishes standards for minimum wages, recordkeeping, child labor and overtime pay. FLSA affects more than 130 million workers across the United States and applies to both full- and part-time employees. According to FLSA, some workers are exempt from overtime pay requirements and minimum wage. These works include employees of some recreational establishments or seasonal amusement; certain employees of small newspapers; seamen employed on foreign ships; newspaper delivery employees; small farm workers; babysitters (casual); and companions to the elderly. Other employees are only exempt from overtime pay, such as farmworkers, certain news editors, some domestic service workers, motion picture theater employees and other workers. The United States Department of Labor (DOL) also indicates that certain hospital employees are partially exempt from overtime pay. For instance, hospital and residential care workers who agree to work for two weeks in place of seven day workweeks may be exempt from overtime pay. If an employee believes that he/she has been unlawfully misclassified to avoid overtime pay, he/she may contact the local Wage and Hour Division office to file a complaint.
