Cleveland-Bernstein prohibiting the child’s mother from removing the child from Illinois. Illinois court documents allege that despite the court’s order, the child’s mother took the child to Tucson, Arizona. It is further alleged in court documents that one of the mother’s other children was removed from her care due to allegations of abuse and neglect. When Cook County Judge Moira Johnson ordered the mother to appear before the court with the child on February 23rd – the mother failed to appear. Subsequently, Cook County Judge Michelle Lowrance issued an order for the immediate turnover of the child to the Illinois father and ordered all local, state, and federal law enforcement authorities to assist in the turnover. Fathers’ Rights Attorney Jeffery M. Leving (http://dadsrights.com) then coordinated emergency efforts in both Chicago and Tucson, with Arizona counsel, to secure the safe return of the child to the Illinois father. In bringing the case close to conclusion, Judge Wayne E. Yehling of the Superior Court of Pima County, Arizona, found that the child was “likely to suffer serious physical harm” if she was not returned to her father and directed the Tucson Police Department to take immediate physical custody of the child and return her to her father. With both Illinois and Arizona court orders in hand, Tucson police officers, who had been given authority to make a forcible entry on private property if necessary, arrived on the scene and secured the return of the child. The swift and safe return of the child to her father’s care is the result of persistent, decisive and deliberate efforts at both the local and long distance levels and the father never giving up hope.
