Attempts to Whitewash Illegal Pompano Beach Community Redevelopment Agency CRA Takings Fail

Nov. 22, 2010 - PRLog -- PompanoBeachCRAGate - The Pompano Beach Community Redevelopment Agency in Broward County, Florida stole prime property from private residents, businesses and churches in the city for private profit even though it didn’t have the power of eminent domain to take properties. A five year-old eminent domain taking case of Pompano Beach CRA v Gil Eriksen Properties LLC is coming to a head as complicity in all the attempts to bury and hide the fact that the takings were illegal are being exposed.

Following is a short list of some of PompanoBeachCRAGate scandals that Florida’s high level politicians, largest law firms, courthouses, government agencies, and corporate interests have been trying to keep under wraps.

Lies Revealed

-- The Pompano Beach Commission was not authorized by Broward County to create a separate legal entity (the Community Redevelopment Agency) nor give it the power of eminent domain to take properties. This illegally created CRA without the power of eminent domain has taken private properties illegally for over a decade, and is still doing it.

-- The Pompano Beach Community Redevelopment Agency and the Pompano Beach Commission have always been made up of the exact same members. Since the members of both entities are the same, it is questioned why another agency was necessary, and contended that it was created to be used as a shill to abscond with property for private gain.

-- The Pompano Beach Community Redevelopment Agency hired and uses The Urban Group private property acquisition firm to stage the illegal takings of private property for the CRA.

-- The Pompano Beach Community Redevelopment Agency uses private external management companies as more legal entity buffers to perpetuate its crimes, like Redevelopment Management Associates LLP, a newly incorporated limited liability corporation headed by Kim Jackson-Briesemeister, a reported lobbyist for developers, along with Chris Brown.

-- The Pompano Beach CRA uses yet more entities, the Advisory Boards to the CRA (one for the East area and one for the West area) under the auspices of community involvement and advisement, to make deals with developers and lenders. The Advisory Board members are hand-picked by the Commissioners, and are not concerned citizens, however, but most often known lobbyists for developers and businesses.

-- The Pompano Beach City Attorney Gordon Linn and the attorney representing the Pompano Beach Community Redevelopment Agency, Mitchell J. Burnstein  of Weiss Serota Helfman Pastoriza Cole & Boniske are aware of the CRA’s illegalities and protect and perpetuate them with a host of brazen, unethical, illicit, illegal, and criminal tactics against the public.

-- The Broward County Circuit Courts allow eminent domain actions by the Pompano Beach CRA to be filed and pursued to this day, even though the CRA is found to have been created illegally and not have the authority of eminent domain to seize property.  Judges further perpetuate the crimes against the public.

-- The Florida 4th District Court of Appeal, the same court that upheld the ruling that the CRA was created illegally and has no power of eminent domain, also continues to allow eminent domain actions by the CRA to this day.

-- Eminent Domain actions are seen as a feeding frenzy for attorneys and experts on all sides of eminent domain actions, even attorneys representing the property owners, to profit from land grabs, including illegal land grabs at the expense of private citizens. Major attorney firms who represent the public against landgrabbing have a reputation for conspiring illegally with the landgrabbers against their own citizen clients.

-- The Broward County Commission, whose role is to oversee Broward County and all the local governments over which it presides, and grant or not grant powers of eminent domain to local municipalities including Pompano Beach, ignores the finding of the CRA’s illegality and the pleadings of victims of the illegal land grabs by the Pompano Beach CRA, allowing the abuse to continue to this day.

-- Illegal land grabs have been and are still going on with no intervention from the Florida Governor, the State Attorney’s office or other watchdog, professional or ethics organizations. Not surprisingly, none of the parties involved in the land grab heists will comment at all.

It seems criminal acts and obstructing justice through falsifying the record, staging trials, lying under oath, and / or intimidating the public, all have not been able to keep PompanoBeachCRAGate under wraps. Florida's land grab cronies are quickly becoming fugitives of justice.
